These Terms of Service ("Terms") govern your access to and use of the AI Helper Suite platform, operated by CloudWorks, Lda ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By using our platform, you agree to comply with and be bound by these Terms, our Privacy Policy, and other applicable policies. If you do not agree to these Terms, please do not use our services.

2. Changes to Terms

We reserve the right to update or modify these Terms at any time. If we make significant changes, we will notify you via email or by posting a notice on our platform. Your continued use of the platform after such changes constitutes your acceptance of the updated Terms.

3. Use of the Platform

You agree to use the AI Helper Suite platform only for lawful purposes and in accordance with these Terms. You must not use our platform in any way that could damage, disable, or overburden our servers or interfere with any other user's experience.

4. User Accounts

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account and password and for any activities that occur under your account.

5. Subscription and Payments

AI Helper Suite operates on a subscription model. By activating a chatbot, you agree to pay a recurring subscription fee of 5€ per chatbot per month. Payments will be processed through Stripe, and you are responsible for providing valid payment details. You may cancel your subscription at any time, but no refunds will be issued for partial months.

6. Prepaid Tokens and OpenAI Key Usage

You may choose to use your own OpenAI API key or purchase prepaid tokens for chatbot interactions. Prepaid tokens are non-refundable and must be used within the allotted time or subscription period. You are responsible for ensuring that your OpenAI key is valid and complies with OpenAI's terms.

7. Intellectual Property

All content, features, and functionality on the AI Helper Suite platform, including but not limited to the chatbot, logos, design elements, and underlying code, are the intellectual property of CloudWorks, Lda or its licensors. You agree not to reproduce, distribute, or create derivative works based on any content without our explicit written permission.

8. Termination of Service

We reserve the right to suspend or terminate your account and access to the platform at any time, with or without notice, for any reason, including a violation of these Terms. Upon termination, your right to use the platform will cease immediately.

9. Limitation of Liability

To the fullest extent permitted by applicable law, CloudWorks, Lda will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the platform.

10. Disclaimer of Warranties

The AI Helper Suite platform is provided on an "as is" and "as available" basis. We do not guarantee that the platform will be uninterrupted, error-free, or secure. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Governing Law

These Terms and any disputes arising out of or related to them will be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law principles.
